The RTO checks itself and each governing person for the matters the Regulator may consider under item 2: findings of guilt for an offence or orders to pay a pecuniary penalty under Commonwealth, State or Territory law whether or not a conviction was recorded (spent convictions protected by Part VIIC of the Crimes Act 1914 excepted), their seriousness and the time elapsed, current court or tribunal proceedings, and findings of guilt for a foreign offence.
