Australia Social Security Act 1991 (Age Pension: qualification, income test and assets test)
Part 3.12: General provisions relating to the assets test (disregarded assets, income streams, encumbrances, disposal of assets, financial hardship) – Australia Social Security Act 1991 (Age Pension: qualification, income test and assets test)

Australia Social Security Act 1991 (Age Pension: qualification, income test and assets test) 1129-1130: Financial hardship rules: unrealisable assets disregarded and the notional income deduction

What does 1129-1130 require?

Where a social security pension is not payable or is reduced by the assets test and the person would suffer severe financial hardship, the person may ask the Secretary to apply the financial hardship rules; if the Secretary is satisfied the person's assets include an unrealisable asset (one that cannot be sold or borrowed against, including land the person is unable to sell in the circumstances defined) and the other conditions in section 1129 are met, the value of the unrealisable asset (and the partner's) is disregarded in the rate calculation and a notional annual rate of return on the asset (as section 1130 provides, the adjusted disposal rules applying) is deducted from the pension payable.
