Military firearms may never be given away under this power. In considering any other gift under section 66, the delegate must start from the principles that property should, where appropriate, go (for payment or free of charge) to another government in Australia or sold at market value where that is economical. Gifting departs from those principles and is allowed only for property that is genuinely surplus and either of historical or symbolic significance to the recipient, of other special significance with compelling reasons, or of low value and either uneconomical to dispose of otherwise or supportive of a government policy objective. A gift that would create an onerous or undesirable precedent must be refused, and the delegate needs publicly defensible, objective grounds for preferring the recipient over others. The Finance Secretary delegation carries the same directions (8.1 and 8.2).
