Australia Online Safety Act 2021
Parts 13, 14 and 16: Information, investigation and service of notices – Australia Online Safety Act 2021

Australia Online Safety Act 2021 s229: Designate and notify a contact person, or keep an Australian agent, for service of notices

What does s229 require?

A summons, process or notice under the Act, or under the Regulatory Powers (Standard Provisions) Act 2014 as it relates to the Act, is taken to be served on a provider of a social media service, relevant electronic service, designated internet service, hosting service, search engine service, app distribution service or internet carriage service if it is served on an employee or agent the provider has designated as its contact person for the Act and whose contact details have been notified to the Commissioner; a body corporate incorporated outside Australia with no registered or principal office in Australia is served through its agent in Australia. Electronic service of notices does not require the recipient's consent (s 228). Because removal and blocking notices run from the time they are given, the designated contact decides when the 24-hour clocks start.
