For an investigation of a complaint under s 31, 34 or 37 or a matter under s 42, the Commissioner may summon a person to attend before the Commissioner or a named delegate to produce documents or answer questions, or to provide documents or information, and may require documents to be made available for inspection and copying. Examination may be on oath or affirmation, in private, with an adviser present, with a record given to the person. Refusing or failing to take the oath or affirmation, answer a required question or produce a required document is an offence (12 months imprisonment) and a civil contravention (100 penalty units), unless the person has a reasonable excuse, the answer or document would tend to incriminate them, or they are a journalist protecting a confidential source. A person giving evidence has a High Court witness's protection.
