Part 5: Ending and enforcing credit contracts, mortgages and guarantees – Australia National Credit Code (Schedule 1 to the National Consumer Credit Protection Act 2009)

Australia National Credit Code (Schedule 1 to the National Consumer Credit Protection Act 2009) s87: Give a first direct debit default notice to the debtor and any guarantor within 14 days

The first time a default occurs on a payment the debtor authorised by direct debit (and, for a low cost credit contract, the first time the debtor is in default on any payment), the credit provider must give the debtor and any guarantor a notice containing the regulation-prescribed information within 14 days of the default (strict liability, 50 penalty units). This one-off notice does not displace any other notice the Code requires.
