Sections 47 to 49 of the WHS Act oblige the PCBU to consult, as far as is reasonably practicable, the workers concerned and their elected HSRs on health and safety matters. Consulting means sharing the information, giving workers and HSRs a fair chance to say what they think, and weighing those views before a decision is made; it never stops. The occasions on which it is mandatory are: finding hazards, assessing risks or deciding what controls to put in; deciding whether welfare facilities are adequate; proposing changes that could touch workers' health or safety; and settling the procedures for consultation itself, for resolving issues, for monitoring workers' health and workplace conditions, and for providing information and training. Workers know which tasks expose them and often have practical fixes to offer. The PCBU should make consultation reachable for everyone, including workers with disability and workers from culturally and linguistically diverse backgrounds, by using their preferred languages, culturally appropriate messengers and messages, and accessible formats such as large print or audio.
