Part IV: Disclosure, misrepresentation, Key Facts Sheets and protected genetic information – Australia Insurance Contracts Act 1984 (Cth)

Australia Insurance Contracts Act 1984 (Cth) s33C: s 33C Provide a Key Facts Sheet for home building and home contents insurance

An insurer provides a Key Facts Sheet in the prescribed form (Form 1 or 2 in Schedule 5 of the Regulations, with the prescribed size, font and colour layout) for home buildings and home contents insurance contracts, within 14 days of a consumer first requesting information about the contract or entering into it, and keeps the current Key Facts Sheet downloadable on its public website. Exceptions apply where the consumer already has an unchanged sheet, came through a broker not acting for the insurer, gave no address, or declined it (Regulations s 13). Breach is a civil penalty provision (5,000 penalty units as specified) and an offence. Giving the sheet does not count as clearly informing the insured of its contents (s 33D).
