For contracts that are not consumer insurance contracts, before entry the insurer clearly informs the insured in writing of the general nature and effect of the duty of disclosure, that it continues until the contract is entered into and, for life insurance, the effect of s 27AA(2); for life insurance it also informs each proposed life insured. Where the insurer accepts or counter-offers more than 2 months after the insured's most recent disclosure, it gives a reminder notice with the acceptance. The prescribed forms in Schedules 1 to 3 of the Regulations may be used. Without the notice, the insurer cannot exercise rights for a non-fraudulent failure of disclosure, and without the reminder it cannot rely on non-disclosure of matters that arose after the last disclosure (s 22(5) to (7)).
