Australia Indigenous Procurement Policy (May 2026)
Section 3 Mandatory Set Aside of certain Commonwealth contracts – Australia Indigenous Procurement Policy (May 2026)

Australia Indigenous Procurement Policy (May 2026) 3.1: Mandatory Set Aside scope: apply the MSA to every remote procurement and to every other procurement wholly delivered in Australia estimated between 80,000 and 200,000 dollars (GST inclusive), except CPR 2.6 and 10.3 procurements, mandated coordinated procurement arrangements, Appendix A exemptions other than Exemption 16, and credit card transactions for remote procurement; determine remoteness by where the majority of value is delivered on the NIAA map

What does 3.1 require?

The Mandatory Set Aside gives Indigenous SMEs the chance to demonstrate value for money before the procuring official approaches the general market. It applies to all remote procurements (a procurement for a contract where most of the value of the goods or services will be delivered in a remote area, judged by the delivery points against the NIAA's remote area map) and to all other procurements wholly delivered in Australia whose estimated value, worked out under the CPR rules, falls between 80,000 and 200,000 dollars GST inclusive. It does not apply to procurements under paragraphs 2.6 or 10.3 of the CPRs, to procurement through a mandated coordinated arrangement, to purchases made under an Appendix A exemption other than Exemption 16, or, for remote procurement, to credit card transactions.
