Limited tender at or above the threshold is allowed only in the circumstances in paragraph 10.3 (for example no suitable submissions in an open approach without substantial change, extreme unforeseen urgency, short-lived exceptionally advantageous conditions, only one business able to supply for art, exclusive-rights or technical reasons, compatible additional deliveries, commodity markets, prototypes and design contest winners); for each such contract an official must file a written report of the value and type, the justifying circumstances, and how value for money was achieved.
