Article 29 Working Party Opinion 2/2017 on Data Processing at Work (WP249) 3.1.3: 3.1.3 No decision based solely on automated evaluation of work performance without a permitted ground

A worker may not be made the object of a decision taken purely by automated means that assesses personal aspects such as work performance and has legal or similarly significant effects on them, unless it is needed to enter into or perform a contract, is permitted by EU or national law, or rests on explicit consent.
