Article 29 Working Party Opinion 2/2017 on Data Processing at Work (WP249) 3.1.1(b): 3.1.1(b) Contract and legal obligation as grounds, with workers fully informed of legally required processing

Processing may rest on the employment contract where the employer must process data to meet its obligations under it (paying the worker, for instance), or on a legal obligation where employment law requires it (tax calculation, salary administration). Where a legal obligation is the ground, the worker must be clearly and fully told about the processing unless an exception applies.
