Part 2: Customer due diligence – AML/CTF Act 2006 (Australia)

AML/CTF Act 2006 (Australia) 28(2)(d): Beneficial owners and control structure

For a non-individual customer the entity must establish the identity of each beneficial owner: an individual who ultimately owns, directly or indirectly, 25% or more of the customer or who controls it directly or indirectly (control includes practical influence over financial and operating policies, s 11). Rules 6-7 treats the matter as established for listed public companies subject to beneficial ownership disclosure, government bodies, and customers controlled by either; Rules 6-8 allows, where all reasonable steps fail and are recorded, identifying and risk-appropriately verifying the chief executive officer or equivalent, and requires the chief executive's identity where the customer has no beneficial owner. Simplified measures for regulated or strata customers are in Rules 6-18.
