ACT Residential Tenancies Act 1997 s91-92: ss 91 and 92 Listing only for qualifying breaches and after review

A lessor, agent or database operator may list a person only if the person was a tenant under an agreement that has ended, breached it, and as a result owes more than the bond or had the tenancy terminated by a court or ACAT order; the listing must relate only to the breach, be accurate, complete and unambiguous, and indicate the nature of the breach. Before listing, the person must be given a free copy of the proposed information (or reasonable disclosure), at least 14 days to object or comment, and any submissions must be considered, unless the person cannot be located or the information is already in public court or tribunal records.
