Victoria Occupational Health and Safety Act 2004 s145: s 145 Officers of partnerships and unincorporated bodies must take reasonable care

Where the Act or regulations impose a duty on, or create an offence by, a partnership, unincorporated association or unincorporated body (including a Crown one), the reference is read as a reference to each officer of it. An officer is guilty only if the offence is attributable to that officer failing to take reasonable care. Maximum fine: 10 000 penalty units for an offence against s 39G(1); otherwise the maximum a court could impose on an individual for the same offence. Regard is had to the officer's knowledge, decision-making ability, others' contribution and other relevant matters. Volunteer officers are not liable under this section.
