Electronic transactions and trade documents – USMCA Chapter 19 - Digital Trade (United States-Mexico-Canada Agreement)

USMCA Chapter 19 - Digital Trade (United States-Mexico-Canada Agreement) Art. 19.6: Do not deny legal validity to electronic signatures; let parties choose authentication methods

What does Art. 19.6 require?

Article 19.6: except as its law provides, a Party may not deny a signature's validity solely because it is electronic, nor prevent transaction parties from agreeing their authentication or signature methods or from proving compliance before authorities; a Party may require performance standards or accredited certification for particular transaction categories and encourages interoperable authentication. For organisations: e-signatures are generally usable across the three markets, subject to category-specific certification rules (such as Mexico's advanced electronic signature for some filings).
