Article 19.16: no Party may require transfer of, or access to, the source code of software owned by a person of another Party, or an algorithm expressed in it, as a condition for importing, distributing, selling or using the software or products containing it; a regulator or court may still require preservation and disclosure to it for a specific investigation, inspection, examination, enforcement action or proceeding, with safeguards against unauthorised disclosure and without affecting trade secret status. For organisations: source code requests tied to market access can be resisted; targeted regulatory or judicial requests cannot.
