Part 2: effectiveness of the security agreement, attachment and the rights and duties of parties – US Uniform Commercial Code Article 9 Secured Transactions

US Uniform Commercial Code Article 9 Secured Transactions 9-204-9-206-after-acquired-future-advances: Use after-acquired property and future advance clauses where permitted, respecting the consumer goods and commercial tort claim limits

What does 9-204-9-206-after-acquired-future-advances require?

A security agreement may reach collateral the debtor acquires later and may secure future advances or other value, committed or not, but an after-acquired clause does not reach consumer goods acquired more than ten days after value was given (except accessions) or commercial tort claims (section 9-204). The debtor's freedom to use, commingle or dispose of collateral and to collect accounts does not make the security interest invalid or fraudulent (section 9-205), and security interests arising in the purchase or delivery of financial assets are addressed by section 9-206. Drafting and monitoring must match the clauses actually used.
