Care obligation (paragraph (a)(2)(ii)) – US SEC Regulation Best Interest (17 CFR 240.15l-1)

US SEC Regulation Best Interest (17 CFR 240.15l-1) a2ii-A: Understand the recommendation and have a reasonable basis that it could suit some retail customers

What does a2ii-A require?

Before recommending a product or strategy, the firm and the individual must exercise the diligence, care and skill of a careful professional to understand what the product or strategy could cost, what it could return and what could go wrong, and must be able to say on reasonable grounds that at least some retail customers would be well served by it. This is the product-level or reasonable-basis element: a recommendation of something the firm has not understood, or that would suit no retail customer, fails here regardless of the individual customer.
