US SEC Digital Assets and Crypto Regulatory Framework
Security status of digital assets (Commission interpretation, March 2026) – US SEC Digital Assets and Crypto Regulatory Framework

US SEC Digital Assets and Crypto Regulatory Framework INT-III: Classify each digital asset in the SEC taxonomy: digital commodity, collectible, tool, stablecoin or digital security

What does INT-III require?

Interpretation Section III: digital commodities (value from the programmatic operation of a functional system and supply and demand, no rights to income or business assets), digital collectibles (art, music, in-game items, meme tokens) and digital tools (memberships, tickets, credentials, title instruments, identity badges) are not themselves securities, though they may be sold subject to an investment contract; digital securities, meaning enumerated securities formatted as or represented by a token (by the issuer or a third party), are securities regardless of format, so the full securities laws apply to their offering and intermediation; an asset may fit no category or more than one.
