Where a Priority CDC uses the expedited closing process, it nominates only an attorney who meets SBA's criteria (law degree, bar membership in the state of practice, professional malpractice cover at SBA's minimum limits and maximum deductible unless a hardship waiver is granted, an SBA-approved 504 closing course and adequate expertise) and who is not its employee or an Associate's, not on its board, not involved in its lending decisions and not otherwise too closely associated, applying through the Lead District Office. The Designated Attorney delivers annual evidence of insurance and bar standing, reports changes immediately and completes the SBA update course every two years; status may be withdrawn for good cause, including unsatisfactory closing packages. SBA may pursue claims against CDC counsel for closing deficiencies, and the CDC pursues its own claims.
