For child-occupied facilities built before 1978 the SBA Lender obtains, for each new loan and within a year of the loan number, a lead risk assessment and lead testing of every drinking water tap and fountain accessible to children (EPA 40 CFR Part 745 and HUD guidelines), keeps the results and does not disburse until lead risk is sufficiently minimized. Any property with current or past on-site dry cleaning using chlorinated or petroleum solvents requires a Phase I and a Phase II covering soil, groundwater and soil vapor, the Phase II by an independent licensed PE or PG with the stated experience. Gas stations follow Appendix 7. Anyone holding a right to indemnification from later owners of the property waives and releases all claims against SBA and the lender in a recorded document (for 504, submitted with title and transaction documents for SBA counsel's approval before funding).
