US No Surprises Act (42 USC 300gg-111 to 300gg-139) and 45 CFR Part 149 149.610(e)-(f): Provide the estimate in writing (paper or electronic as chosen) in plain language, keep it in the medical record, supply copies for 6 years, and correct errors promptly

What does 149.610(e)-(f) require?

The estimate must be provided in paper or electronic form as the individual requests, in a form that can be saved and printed when electronic, within the required timeframes, written clearly in a manner calculated to be understood by the average uninsured or self-pay individual; oral information may be given on request but the written estimate must still be issued. Each estimate is part of the patient's medical record and must be maintained as such, with a copy of any estimate issued within the previous 6 years supplied on the individual's request. A good faith error or omission, or reliance in good faith on information from another provider, does not breach the section if corrected as soon as practicable, but the provider remains exposed to patient-provider dispute resolution if services were furnished before the correction and billed charges substantially exceed the estimate. Estimates issued under State processes that do not meet the Federal content do not comply.
