A provider or supplier may not sell its Medicare billing number or privileges or allow another individual or entity to use its number. For a change of ownership under Part 489, the current owner and the prospective new owner must complete and submit enrollment applications before the change is completed; the seller may be sanctioned for failing to report even after the change, and if the new owner does not submit a new application with its information within 30 days of the change, or submits an incomplete one, CMS may deactivate the billing number. Where a home health agency or hospice undergoes a change in majority ownership by sale (asset sale, stock transfer, merger or consolidation, including cumulatively) within 36 months after its initial enrollment or its most recent change in majority ownership, the provider agreement and billing privileges do not convey; the new owner must enroll as a new HHA or hospice and obtain a State survey or accreditation, unless the HHA or hospice has filed 2 consecutive years of full cost reports since enrollment or the last change, the parent is restructuring internally, the owners are changing only the business structure, or an individual owner has died. A DMEPOS supplier whose majority ownership changes within 36 months must likewise enroll anew and obtain a new survey and accreditation, with the same restructuring, business-structure and death exceptions. Suppliers not covered by Part 489 must report any change of ownership or control within 30 days, and a change that changes the TIN generally requires a new application from the new owner.
