US Internal Revenue Code Section 3402 Income Tax Withholding at Source (26 USC 3402) 3402q-r-s-t-gambling-tribal-vehicle-stock: Withhold on reportable gambling winnings and per-capita Indian casino distributions at the statutory rates, exempt vehicle fringe benefits on notice, and apply the stock compensation rule

What does 3402q-r-s-t-gambling-tribal-vehicle-stock require?

Every person, including a government, paying winnings subject to withholding (proceeds over five thousand dollars from a wager in a sweepstakes, wagering pool, lottery or other wagering transaction with odds of at least 300 to 1, with bingo, keno and slot machine winnings and certain pari-mutuel winnings excluded) must withhold at the third lowest individual rate; the winner must furnish a statement with name, address and identification number, and the payer files the return. Distributions of net casino gaming revenues made by an Indian tribe to members under an approved allocation plan are withheld as if annuity payments under the annualised tables, except where a payment is not includible in gross income. An employer may elect not to withhold on the value of a vehicle fringe benefit if it notifies the employee by 31 January of the year, or within thirty days of first providing the vehicle, and includes the value on the Form W-2 by the due date. Subsection (t) sets the withholding rate on qualified stock for which a section 83(i) deferral election is made at the maximum individual rate.
