US Federal Motor Carrier Safety Regulations (49 CFR Parts 350 to 399) 385.300-423: New entrant safety assurance program and the hazardous materials safety permit: 18-month new entrant audit, the permit requirement for listed hazmat and the permit conditions (385.301 to 385.337, 385.401 to 385.423)

What does 385.300-423 require?

A new entrant motor carrier must register with FMCSA before operating, is subject to a safety audit within its first 12 months (18 months for some) and must pass it, with the 16 automatic failure items in 385.321 (for example no alcohol and drug testing program, operating without insurance, using a disqualified driver, false records of duty status) causing revocation of registration unless corrected, and must maintain safety management controls to keep permanent registration. A carrier transporting the materials listed in 385.403 (highway route controlled quantities of Class 7, more than 25 kg of Division 1.1 to 1.3 explosives, more than one litre of certain poison inhalation hazard materials, bulk shipments of methane or liquefied natural gas, and large bulk compressed or refrigerated gases and certain other materials) must hold a hazardous materials safety permit, meet the 385.407 safety rating and crash rate conditions, maintain the 385.415 communications and security plan and route conditions, carry the permit on the vehicle, and renew it every two years.
