Part 382: Controlled substances and alcohol use and testing, and the Clearinghouse – US Federal Motor Carrier Safety Regulations (49 CFR Parts 350 to 399)

US Federal Motor Carrier Safety Regulations (49 CFR Parts 350 to 399) 382.701-727: Drug and Alcohol Clearinghouse: pre-employment full queries, annual limited queries, reporting of violations within three business days, driver consent and the prohibition on employing drivers in prohibited status (382.701 to 382.727)

What does 382.701-727 require?

An employer must query the FMCSA Drug and Alcohol Clearinghouse before hiring a driver (a full query with the driver's electronic consent) and at least once a year for every employed CDL driver (a limited query with written or electronic consent, followed by a full query within 24 hours if information exists), and may not permit a driver with a prohibited status in the Clearinghouse to perform safety-sensitive functions. The employer and its service agents must report to the Clearinghouse within three business days each verified positive, adulterated or substituted test, each alcohol result of 0.04 or greater, each refusal, each actual knowledge violation, each negative return-to-duty result and each completion of follow-up testing. Employers must register in the Clearinghouse, keep query records for three years, and the MRO and SAP report their respective determinations. Drivers must register to respond to full-query consent requests.
