UK Land Registration Act 2002
Part 7 and Schedule 4A: Special cases (Crown land, bankruptcy, overseas entities, pending actions) – UK Land Registration Act 2002

UK Land Registration Act 2002 85A: Overseas entities: registration restrictions under Schedule 4A

What does 85A require?

Schedule 4A (inserted by the Economic Crime (Transparency and Enforcement) Act 2022) prevents an overseas entity being registered as proprietor of a qualifying estate unless it is a registered overseas entity (on the Companies House register of overseas entities) or exempt, requires the registrar to enter a restriction on titles held by overseas entities, and makes a registrable disposition by an overseas entity that is not registered (or in breach of the restriction) incapable of registration, with offences for the entity and its officers. Sections 86 and 87 deal with bankruptcy entries and pending land actions, writs and orders, which the registrar enters as notices or restrictions.
