Registered charges rank in the order shown on the register (section 48). A chargee may make a further advance ranking ahead of a subsequent charge if no notice of the subsequent charge has been received, if the further advance is obligatory and noted, or if a maximum amount is agreed and entered (section 49). A proprietor of a statutory charge with priority over existing charges must be notified as rules provide (section 50). On registration a charge takes effect as a charge by deed by way of legal mortgage (section 51), with the disponee protection in section 52 and sub-charge powers in section 53. A chargee exercising a power of sale is taken to have notice of everything on the register when applying proceeds under section 105 of the Law of Property Act 1925 (section 54).
