UK Land Registration Act 2002
Part 4: Notices and restrictions – UK Land Registration Act 2002

UK Land Registration Act 2002 32-36: Notices: nature, excluded interests, agreed and unilateral notices and their cancellation

What does 32-36 require?

A notice is an entry in respect of the burden of an interest affecting a registered estate or charge; it protects priority but does not validate the interest. No notice may be entered for an interest under a trust of land, a lease of three years or less, a restrictive covenant between lessor and lessee, or the other excluded interests in section 33. A person claiming an interest may apply for an agreed notice (with the proprietor's consent or proof of the claim) or a unilateral notice, of which the registrar must notify the proprietor; the proprietor may apply to cancel a unilateral notice, and it is cancelled unless the beneficiary objects within the period the rules provide (sections 34 to 36). Section 77 makes lodging a notice without reasonable cause actionable.
