The manufacturer must revisit the value assessment regularly for as long as the product lives, to confirm fair value is still being delivered, and the obligation covers closed and existing products on a forward-looking basis. Where a review finds fair value is no longer there the manufacturer must act appropriately: mitigate and, where appropriate, remediate harm to existing customers, prevent further harm, and tell distributors about the issue and the changes made. A distributor that finds the same must also act, in a way that depends on its role. For closed products and products held before the Duty came in, appropriate action does not require giving up vested contractual rights unless a breach of earlier rules is found. Specific carve-outs apply to non-investment insurance and funeral plans under PROD and to certain winding-up funds, and firms subject to the independent governance committee rules may rely on them in part.
