Texas Data Privacy and Security Act (TDPSA) S541-055E: Honour opt-outs from authorised agents, including universal opt-out signals (from 1 January 2025)

Consumers may designate an authorised agent, including through a browser setting, extension or device-wide global setting, to opt out of targeted advertising and sale; the controller must comply where it can verify the consumer and the agent's authority with commercially reasonable effort, unless the signal is unclear, Texas residency cannot be verified, it cannot process the request, or it does not process similar signals under other states' laws. The technology must not be a default setting, must reflect an affirmative choice, must be easy to use and must not unfairly disadvantage other controllers.
