The directors of a company, from time to time on or after the day the company's obligation arises, must cause the company to comply with that obligation. The obligation continues until the company complies, an administrator is appointed under the Corporations Act 2001, or the company begins to be wound up. The Commissioner must not commence or progress proceedings to recover a penalty from a director while a payment-by-instalments arrangement covering the company's obligation is in force.
