A government agency is liable for damage from unlawful collection, processing, use or other infringement unless caused by force majeure; a non-government agency is liable unless it proves no intent or negligence. Non-pecuniary damage is compensable, courts may award NT$500 to NT$20,000 per person per incident where actual loss is hard to prove, and total liability for one incident affecting many people is capped at NT$200 million or the benefit involved if higher; claims lapse two years after knowledge and five years after the damage.
