An owners corporation must properly maintain and keep in a state of good and serviceable repair the common property and any personal property vested in it, and must renew or replace fixtures and fittings comprised in that property (s 106(1), (2)). The duty does not apply to an item the owners corporation determines by special resolution is inappropriate to maintain where safety and appearance are unaffected (s 106(3)), and may be deferred while the owners corporation pursues action against the person responsible for damage (s 106(4)). An owner may recover reasonably foreseeable loss from a breach as damages for breach of statutory duty, within 2 years of first becoming aware of the loss (s 106(5), (6)), subject to any common property memorandum or by-law under s 108.
