Article 23 (paragraph 1 as amended by Ley 10/2025, in force 28 December 2025): processing to avoid sending commercial communications to objectors is lawful; highly representative associations may run general or sector exclusion systems, which may include preference services limiting communications to chosen companies, and must notify the supervisory authority, which publishes a list; a controller told that a person does not want marketing must inform them of the systems; anyone planning direct marketing must first consult the relevant exclusion systems on the published list and exclude objectors, unless the person consented to receive that sender's communications.
