A requester or third party may appeal a decision of the information officer of a national or provincial department, administration or municipality to the relevant authority on Form 4 within 60 days (30 days where third-party notice applies); late appeals must be allowed on good cause. The information officer must send the appeal, its reasons and third-party contact details to the relevant authority within 10 working days. The relevant authority must notify affected third parties or the requester within 30 days and allow 21 days for representations, decide within 30 days (or as the Act specifies), give reasoned notice without referring to the record's content and stating the 180 day court route, and give access forthwith or after the challenge period; failure to decide in time is a deemed dismissal. Complaints to the Regulator from these bodies lie only after the internal appeal is exhausted.
