Chapters 10 and 11: financial matters, offences, regulations and transition – South Africa National Health Insurance Act 20 of 2023

South Africa National Health Insurance Act 20 of 2023 54-2: Daily penalty for failing to furnish information required by the Act or a directive

What does 54-2 require?

A person or entity that does not give the Fund or its agent the information the Act or a directive under it requires, within the prescribed or specified period or any extension, must pay a prescribed fine for every day the failure continues, regardless of any criminal proceedings, unless the Fund waives it on good cause; the penalty is recoverable by the Fund as a debt (section 54(2) and (3)). Information requests, directives (section 56) and prescribed reporting (section 55(1)(r)) therefore need owners and deadline tracking.
