During an investigation the Commissioner may summon anyone believed able to furnish information, or holding a book, document or other object bearing on the subject, to appear and be interrogated or to deliver the specified items at a stated time and place (section 49A(1)). A person questioned must give truthful answers to every question, as fully as they are able, though not obliged to give a self-incriminating answer; self-incriminating answers are inadmissible in criminal proceedings except for perjury or the section 72 and 73(2)(d) offences (section 49A(2) and (3)). Failure to attend, to remain, to be sworn or to produce items in one's possession or control is an offence (section 71), as is failing to answer fully or giving evidence known to be false (section 72).
