Part 5: declared online locations – Singapore Protection from Online Falsehoods and Manipulation Act (POFMA, 2019)

Singapore Protection from Online Falsehoods and Manipulation Act (POFMA, 2019) s37: s.37(1) to (3) Advertisers, digital advertising intermediaries and prescribed platforms: keep paid content off declared locations and stop promoting them

What does s37 require?

Service providers (advertising advisers and agencies) and digital advertising intermediaries must take reasonable steps, within 10 working days of a Declaration taking effect, so that paid content they place is not communicated in Singapore on a declared location; prescribed digital advertising intermediaries and prescribed internet intermediaries must take reasonable steps not to facilitate Singapore paid content that publicises a declared location. Automatic placement is no defence; prescribed steps are deemed reasonable; not knowing of the declaration is a defence.
