Where monitoring systems using electronic communications and/or video surveillance are used at the workplace, processing employees' personal data for the employer's legitimate interests is permitted only if: (a) the employer's legitimate interests are thoroughly justified and prevail over the employees' interests, rights and freedoms; (b) the employer has given employees mandatory, prior, complete and explicit information; (c) the employer consulted the trade union or, as appropriate, employee representatives before introducing the monitoring; (d) other, less intrusive means have not previously proved effective; and (e) storage is proportionate to the purpose and no longer than 30 days, except where the law expressly provides otherwise or in duly justified cases.
