Articles 99 and 100: Member States set effective, proportionate and dissuasive penalties for infringements, in particular those not covered by Articles 63 and 64, notify them by 26 March 2027, and weigh nature, gravity, scale, duration, mitigation, previous infringements, gains and Union turnover; anyone who suffers material or non-material damage from an infringement may claim compensation under Union and national law.
