Article 52: protected data is still made available under the Regulation; holders inform the health data access body of data containing IP, trade secrets or regulatory data protection, identify the parts concerned and justify the protection, with the dataset description or at the latest on request; the body takes protective measures, may attach contractual or technical conditions, and refuses access where a serious risk of infringement cannot be addressed, with holders and applicants able to complain.
