Queensland Property Law Act 2023
Chapter 4 Part 1: Contracts for the sale of land (implied conditions, settlement, deposits, instalment contracts) – Queensland Property Law Act 2023

Queensland Property Law Act 2023 76: Implied conditions in every contract for the sale of land

What does 76 require?

Every contract for the sale of land includes the implied conditions in section 76: the seller gives the buyer, at the seller's cost, a copy of each document in the seller's possession relating to a registered caveat; the seller removes any objection to registration of documents required to give effect to the contract (other than one arising from the buyer's own act); the buyer is entitled to the documents of title; and the other conditions the section lists. Section 73 provides that stipulations as to time are not of the essence unless the contract says so or a notice makes them so.
