A contract for the disposition of land is not enforceable by action unless the contract, or a memorandum or note of it, is in writing and signed by the party against whom it is sought to be enforced (or that party's lawfully authorised agent). The creation of a legal or equitable interest in land by a disposition is likewise required to be in writing signed by the person creating it, subject to the parol exceptions in sections 9 and 10 (short leases, resulting and constructive trusts, part performance). Section 69 applies the same writing rule to guarantees.
