Qatar Central Bank Cloud Computing Regulation (2024) 18: Provide for termination: data return and removal, termination triggers, minimum execution period and CSP exit assistance

What does 18 require?

On termination, whether on expiry or early, the entity is able to retrieve all its data including backups; the CSP hands every piece of data back to the entity, removes it from its own environment and renders it irrecoverable; the contract states clearly the situations in which the entity may terminate on default or otherwise, including a change in the CSP's ownership, insolvency or liquidation, receivership or judicial management in Qatar or elsewhere, a material breach touching data, security or confidentiality, a demonstrable deterioration in the CSP's ability to perform, and a proposed move of data to a location the entity finds unacceptable; the agreement specifies a minimum period to execute termination; it commits the CSP to assist the exit without unreasonably impeding it, including the format and manner of data return and support to keep data accessible through transition; and the parties agree the data to be returned on termination and review it whenever the arrangement changes materially.
