Chapter II: Punishable acts an organisation must prevent in its own conduct – Philippines Cybercrime Prevention Act (RA 10175)

Philippines Cybercrime Prevention Act (RA 10175) Sec. 4(c): Content offences in the organisation's publishing and platforms

What does Sec. 4(c) require?

The organisation must not engage in, maintain, control or operate the lascivious exhibition of sexual organs or sexual activity with the aid of a computer system for favour or consideration (cybersex, upheld in Disini), must not commit child pornography offences under RA 9775 through a computer system (penalty one degree higher), and, as original author of a post, must not publish libel as defined in the Revised Penal Code through a computer system (online libel; after Disini and IRR Rule 2 Section 5(3) only the original author is liable, not those who merely receive or react to the post, and prosecution under both RA 10175 and the Revised Penal Code for the same libel is barred). The Supreme Court held in 2026 (Causing) that cyber libel prescribes one year from discovery. Section 4(c)(3) on unsolicited commercial communications was declared void in Disini and carries no duty.
