NSW Food Regulation 2025 116A-116D: Primary producers of berries, leafy vegetables and melons meet Standard 4.1.1 and the horticulture standards 4.2.7, 4.2.8 and 4.2.9 at the scale-based level, with Standard 3.2.1 programs above 10 hectares

What does 116A-116D require?

Berry primary producers meet Standard 4.1.1 clauses 1 to 3 and Standard 4.2.7. For leafy vegetables and melons the duty scales with cultivated area: micro producers (under 2 hectares) notify under Standard 3.2.2 clause 4 and meet Standard 4.1.1 clauses 1 to 3 and Standard 4.2.8 or 4.2.9, which NSW modifies so the general food safety management clause 4 does not apply below 2 hectares; small producers (2 to under 10 hectares) meet Standard 4.1.1 and Standard 4.2.8 or 4.2.9 in full; those above 10 hectares also run a Standard 3.2.1 food safety program. Primary horticulture processors whose only activity is storing or transporting harvested berries, leafy vegetables or melons are outside the horticulture standards. In force from 12 February 2026.
