Part 6: Enforcement and remedies (offences, penalty notices, show cause, trading prohibition orders, compensation) – NSW Fair Trading Act 1987

NSW Fair Trading Act 1987 72-73: Show cause action and trading prohibition orders for repeated unlawful conduct

What does 72-73 require?

Where the Secretary is satisfied that a person has engaged in unlawful conduct (a contravention of the Act other than the unfair contract terms Part) in trade or commerce on more than one occasion, anywhere, the Secretary may serve a notice requiring the person to show cause why action should not be taken (section 72) and, after considering submissions, may apply to the Supreme Court for an order prohibiting the person from carrying on business, or a specified business, in New South Wales for the period the court fixes, or imposing conditions (section 73); contravening the order is an offence. The Secretary may also accept enforceable undertakings under the ACL and keep them on the public register (section 86B).
